Welcome to Crillon Tours S.A. The Crillon Tours S.A. website (our “Website”) is a service offered by Crillon Tours S.A. Please read these Terms of Use carefully before obtaining any content, products or services through our Website. By accessing, using or obtaining any content, products or services through our Website, you agree to be bound by these terms and the terms of our privacy policy, which can be found here. You also agree to use our Website in compliance with all applicable laws, rules and regulations. We have the right to update these terms at any time without notice to you by posting an updated Terms of Use on our Website.

Additional Terms

Additional terms, including our Terms and Conditions for travel bookings, may apply when you book products or services with us. Independent suppliers that we use, such as airlines and hotels, have their own policies and agreements.

Minors

Our website is not directed to children under 18 (“Minors”), and we do not offer products or services for use by children. Minors are specifically prohibited from booking, purchasing and using any products or services available on our Website.

Responsible Party

You agree to protect the secrecy of your username and password (“login information”) to access restricted portions of our Website. You will be responsible, financially or otherwise, for all use of our Website by you and anyone using your login information. You represent and warrant that all information that you submit to us about yourself and others, including name and email addresses, is true, valid and accurate, and that you have the right to give us such information.

Intellectual Property

All information, text, logos, images, graphics, software and other content that make up our Website are the property of Crillon Tours S.A. or its licensors and are protected by copyright, trademark, patent, trade secrets, unfair competition, and other U.S. and international laws, through the application of local laws or other treaties. Limitation of Liability

Your use of this Website and its content is at your sole risk, subject to applicable law. Services and products made available on our Website are subject to conditions imposed by our independent suppliers, including but not limited to tariffs, conditions or carriage, international conventions and arrangements, and federal government regulations. Any independent suppliers who furnish products or services through our Website are independent contractors, and not agents or employees of Crillon Tours S.A. You agree to assume any and all liability for use of the information and other material on our Website. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CRILLON TOURS S.A AND/OR ITS INDEPENDENT SUPPLIERS BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT, INCIDENTAL OR OTHER DAMAGES, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ACCESS OR USE OF OUR WEBSITE, WHETHER SUCH DAMAGES ARISE IN CONTRACT, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW OR OTHERWISE, EVEN IF CRILLON TOURS S.A HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU EXPRESSLY WAIVE ANY RIGHT YOU MAY HAVE TO RECOVER SUCH DAMAGES.

Indemnification

You agreed to defend, hold harmless and indemnify Crillon Tours S.A and any independent supplier, and either of their respective officers, directors, employees and agents from and against any claim, cause of action or demand, including reasonable legal and accounting fees, in any action filed or commenced by a third party against Crillon Tours S.A arising out of or related to (1) your breach of these Terms of Use or the documents made part of these Terms by reference, (2) your violation of any law or rights of a third party, including intellectual property rights, or (3) your use of our Website.

Violations

Crillon Tours S.A reserves the right to seek all remedies available at law and in equity for violation of this agreement, including the right to block access from a particular Internet address to our Website.

Severability

If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision.

BOOKING TERMS AND CONDITIONS

Kindly read this agreement thoroughly and carefully. before booking with us.

Agreement: The terms and conditions set forth in this agreement constitute the entire understanding and agreement between you the trip “Participant” and Crillon Tours S.A. “Crillon Tours” with respect to any and all bookings, tours or transactions made with Crillon Tours.

You accept all of the terms in this agreement and direct us to perform services on your behalf. All persons named in this booking (“Participants”) are subject to this agreement. You affirm that you have made all other Participants listed in the booking aware of these terms – regardless of how final payment is made – and that all Participants accept these terms.

Booking: Crillon Tours services can be purchased directly or by authorized agents throughout the world. You may also reserve a tour by email/online booking form/online store. A booking is not final until you receive a final confirmation from us or your travel agency.

Rates: Rates valid from January to December 2020. This is only a quote proposal. Once we receive your confirmation, the same one is subject to availability. Referential net rates, subject to confirmation at the time of booking. All rates are quoted in US Dollars effective on the date.

Deposits and Final Payment: A deposit of 50% per person is required at the time of booking. Final payment is due 35 days prior to arrival for FITs and 45 days for groups. If your booking is made within 30 days of arrival, the entire payment will be requested unless specified otherwise.

Prepayment is requested 30 days prior to the arrival date in Bolivia and may be made by credit card, cash, or wire transfer. If you pay your deposit by wire, we cannot confirm your reservation until your payment has cleared the bank. Bank fees and credit card fees must be assumed by the client.

Cancellations Policies and Refunds:  To cancel your booking, you must submit your request to us by email. Cancellation fees will be applied according to the following terms, based on the date we receive your written notification:

  • No-show and last-minute cancellation, 100%
  • Within 7 days prior, 50% for FITs and 100% for groups
  • Special policy in Uyuni: up to 35 days prior to arrival, 100%
  • These terms might change at any moment without previous notice

No refunds will be provided for any non-taken portion of a tour once the tour begins or due to a Force Majeure situation. For this reason, we strongly encourage you to purchase travel insurance covering these special circumstances. Exchange rates, bank fees and credit card fees are non-refundable.

Changes:  If you change your tour dates or alter your itinerary after we confirm your tour, a change fee might be applied. The type and scope of change dictates the amount of the change fee.

Cancellations or Changes by Us and Flexibility: We reserve the right to cancel, alter or modify any tour without prior notice for the safety and/or comfort of clients. You acknowledge that the amenities, accommodations, transportation, route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems, and other unforeseeable factors. If, prior to arrival, we make a significant change because of a problem with a supplier (e.g., bankruptcy), we will, as soon as reasonably possible, notify you of available alternatives.

Any changes may require a supplemental payment from you or result in a refund less any cancellation fees and nonrefundable deposits. If we cancel, which is rare, a check for a full refund will be issued to you less any airline ticket cancellation fees and nonrefundable deposits advanced to local suppliers. This refund will constitute full settlement of claims you may have arising out of our cancellation. No refunds under this paragraph will be provided due to cancellations or changes due to Force Majeure. Crillon Tours is quite flexible as far as is reasonable.

Price Adjustments:  The quoted tour price is based on tariffs, fees, airfares, and costs in effect at the time of booking. We reserve the right to increase the quoted price after booking if inflation, costs of fuel, labor or materials, airfares, supplier costs, currency exchange rates, tariffs, government fees, and admission charges change. You agree to and will pay for any price increase.

Credit Card Authorization for Post-Booking Charges: You authorize Crillon Tours S.A to charge your credit card number for any change fees, price increases, or supplemental payments that you incur post-booking. If you prefer a different payment method, you must notify us in writing at the time of booking.

No Refunds for Personal Expenses: You will not be reimbursed for any personal expenses such as airfare, hotel or other travel expenses due to changes in itineraries or tour cancellations.

Responsibility: Crillon Tours S.A. acts only as an intermediary for some independent suppliers that provide lodging, meals, transportation, sightseeing, activities or other goods and services connected with your tour (“Supplier” or “Suppliers”). You acknowledge that you are aware and clearly understand that these Suppliers are independent contractors, are not managed by Crillon Tours S.A. and are not agents or employees of Crillon Tours S.A. A Supplier’s services are subject to the Supplier’s own terms and conditions and the local laws and regulations of the relevant country.

Force Majeure: Crillon Tours S.A. will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond the reasonable control of Crillon Tours S.A., including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, sickness, quarantine, government intervention, weather conditions, and unforeseen circumstances.

If Crillon Tours S.A. and/or any of its Suppliers are affected by Force Majeure, they shall be entitled to, and may in their sole discretion, vary or cancel any itinerary or arrangement in relation to the tour. Regarding civil unrest, once Crillon Tours S.A.  has investigated the prevailing situation, as it deems fit, it shall remain in Crillon Tours sole and absolute discretion whether to proceed with the tour.

Travel Insurance:  The tour price does not include travel insurance. We strongly recommend that you purchase comprehensive travel insurance, covering trip interruption and cancellation, baggage, medical, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you. You agree to assume all costs of medical care and transportation. As such, we require that you purchase travel-related insurance if your current medical policy does not cover you during your tour. We may require proof of coverage.

Pre-Departure Documentation:  It is important that you carefully read all trip-related documents that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect. We cannot accept any liability if you do not notify us of any inaccuracies within 7 days (FITs) and 30 days (Groups) of your receipt of those documents. This agreement, a waiver of liability and assumption of risk agreement and, if required, a medical statement or certification must be signed and submitted by you. If you fail to submit this and other necessary documentation prior to departure, we reserve the right to treat your booking as cancelled by you and impose the cancellation fees described in this agreement.

Passports and Visas:  You are responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire tour. Passports are required for all people traveling abroad and should be valid for at least 6 months after your date of return.  Other required documents may include visas, permits, and vaccination certificates. You assume complete and full responsibility for checking and verifying all passenger’s required travel documents. You are also solely responsible for any adverse consequences resulting from incomplete or defective documentation. While we may provide information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment in good faith as a courtesy to you, we are not responsible for any errors or omissions as to the information provided.

Health Requirements and Medical Care:  You represent that you do not have any physical or other conditions that would create a hazard for you or other Participants or affect other people’s enjoyment of the tour. If you have a physical condition, dietary restrictions, or other conditions that will require special attention during the tour, you must inform us in writing when the booking is made. We may require a medical certificate if you have a special condition. We reserve the right in our sole discretion to accept, decline, or remove anyone from a tour (at arrival or during the tour) who we judge to be incapable of meeting the tour’s physical demands.

Crillon Tours S.A. assumes no responsibility for any medical care provided to you. You agree to assume all costs of medical care and related transportation that are provided to you during the tour.

Complaint Procedure:  If you have a complaint during your tour, you must promptly notify Crillon Tours S.A. or your tour leader of the problem so that they can attempt to remedy the situation. Failure to do so while you are on the tour will extinguish or reduce your ability to claim compensation from Crillon Tours S.A. Further, if you attempt to address the problem on your own without using this notice procedure, you assume responsibility for any added costs you may incur and forfeit any potential refunds.

If you are not satisfied after using this notice procedure, you must submit your complaint in writing to Crillon Tours S.A. within 7 days of the tour’s end date. Crillon Tours S.A. will not accept any liability for claims received after this period.

Tour Start Date: It is your responsibility to be ready to embark on the tour as specified in the itinerary. Crillon Tours S.A. is not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures.

Compliance with Local Laws and Tour Etiquette: You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other trip members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. During the tour, Crillon Tours S.A. or the local guide/supplier has the right in its sole discretion to remove anyone a) who it judges to be incapable of meeting the demands and requirements of participating in the tour activities; or b) who it determines to detract from others’ enjoyment of the tour.

Limitation of Remedies:  You agree that the sole remedy for any default by Crillon Tours S.A.  arising under this agreement shall be the return of the paid tour cost. To the maximum extent permitted under applicable law, Crillon Tours S.A. shall not be liable for any special, consequential, indirect, incidental or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Crillon Tours S.A. has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.

Successors and Assigns: This agreement shall inure to the benefit of and be binding upon Crillon Tours S.A. and the Participant and their respective heirs, legal personal representatives, successors and assigns.

Updating of Terms and Conditions: Crillon Tours S.A. reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions. The latest terms and conditions can be found on the Crillon Tours S.A. website https://crillontours.travel.

IMPORTANT NOTES ON OUR SERVICES

HOTELS IN BOLIVIA

  • Check in time at the hotels is after 12 PM.
  • Official hotels’ classification in Bolivia do not always match international levels.
  • Please note that hotel rates in Santa Cruz are increased in September, during the EXPOCRUZ International Trade Fair.

LAKE TITICACA

  • Hydrofoil packages on Lake Titicaca are in shared basis with other guests. Private services on request.
  • The order of the visits on the Lake can be changed, however all visits will be honored.
  • We kindly ask our guests staying overnight at ‘Posada del Inca Eco-lodge’ on Sun Island, to take only a small bag with personal effects they will need for the overnight. The rest of the luggage will be kept in our deposit in the lower part of the Island.

UYUNI SALT FLATS

  • We always book the best available hotels at the Uyuni Salt Flats and the REA -National Reserve Eduardo Avaroa-, but hotels in the REA are rustic and with a basic service, due to the far-off location with the supply & distribution centers, including electricity. The Salt Lake hotels are unique, but sometimes they also have some limitations for the same reasons.
  • During rainy season -usually from December to March-, the Uyuni Salt Flats, as well as the Red & Green Lagoons can become flooded any moment and it won’t be possible to visit some attractions in order to preserve passenger’s safety complying with official authorities’ regulations. On the other hand, we warn our visitors that roads at the Salt Flats area are not paved and during rainy season, the journeys can take much longer.
  • In the border area with Hito Cajon in Chile, occasional snowstorms can occur affecting passengers transfer from/to San Pedro de Atacama, and the route may have to be changed at an additional cost.
  • Visits such as Sunset and Sunrise tours, Star gazing and Water Mirror Reflections are subject to weather conditions.

OTHER

  • Most museums in Bolivia are closed on Mondays and some of them on Sundays.
  • The visit to Tarabuco Indigenous Market in Sucre, can only be made on Sundays.

SPECIAL ENTRANCE FEES

According to special protocols, the following entrance fees must be paid by guests on the spot:

  • When visiting Madidi National Park, an entrance fee to the park is charged on site (USD 30.00 approximately) and to Pampas area (USD 22.00 approximately); this fee is not included in our quotation.
  • When doing the FD Biking tour to Coroico, an entrance fee to the Cotapata National park is charged on site (USD 10.00 approximately), this fee is not included in our quotation.
